What To Do After a Slip and Fall Accident in Ontario

In Ontario, the Occupiers’ Liability Act (OLA) outlines the duty of care that is bestowed upon property owners for their patrons. Property owners (or occupiers) must take reasonable care to ensure the safety of visitors who frequent their premises. Some of the things that property owners are responsible for include but are not limited to:

  • Regular inspections of the property to ensure the premises are safe for patrons. This includes things like identifying hazards such as uneven floors and/or stairs, damaged railings and/or ensuring things like sidewalks and alleyways are maintained in the wintertime to prevent slipping hazards
  • Ensuring that repairs for deficiencies are conducted in a timely and prompt manner
  • Ensuring that equipment such as escalators, elevators and other equipment are well-maintained and functioning properly
  • Adequate lighting both indoors and outdoors so patrons can see potential hazards
  • Ensuring proper fencing and signage around swimming pools to prevent pool accidents
  • And more

If an occupier fails to meet their duty of care and someone ends up injured on the property due to unsafe condition(s), they may be held liable for damages. The injured party may seek compensation for things like medical expenses, lost wages, pain and suffering and other economic and non-economic losses based on the severity of the injuries.
